Bear Cubs Confiscated After Joint Sting Operation

Transnational Illegal Wildlife Trade monitored by Joint Asian Networks (Some details, names and places are kept private to protect our investigation methods, staff and informants identities)

With the upcoming WARN ASIA Online Illegal Wildlife Trade Monitoring Workshop on 21st and 22nd of January at Wildlife Friends Foundation Thailand, we are delighted to share with you a rather unprecedented and unexpected arrest of an illegal wildlife trader who posted the sale of several wild animals, including Asiatic black bear cubs, red pandas, and an Asiatic golden cat, on multiple social media platforms.

This person targeting consumers of illegal wildlife in Thailand was traced back to Vietnam by our Illegal Wildlife Trade Investigation Team (IWTI-WFFT), and after gathering more info and an actual location of this individual, we set up an operation to get close to this illegal trader. Due to complications with authorities and logistics, we were unable to get the trader to deliver any wildlife for sale in Thailand, and the decision was made to contact our partners Education for Nature – Vietnam (ENV) in Vietnam to further investigate and set up an undercover sting operation. ENV gathered more important information on the trader and engaged with Vietnamese police with an undercover agent posing as a potential buyer.

Two days ago this operation resulted in the arrest of a Vietnamese female and the confiscation/rescue of two Asiatic Black bear cubs. The arrested woman will not be serving jail term as she currently has a baby under the age of 36 months, a law, or rather loophole, known to be useful for criminals in Vietnam to use for illegal trade in wildlife, drugs and human trafficking.

The bears were handed over to a wildlife rescue centre in Vietnam. ความร่วมมือระหว่างองค์กรเครือข่ายในภูมิภาคเอเชียในการต่อต้านเครือข่ายอาชญากรรมการค้าสัตว์ป่าข้ามชาติ

สำหรับงานเวิร์คช็อปของเครือข่าย WARN ASIA ที่กำลังจะจัดขึ้นในวันที่ 21 และ 22 มกราคม 2562 ณ มูลนิธิเพื่อนสัตว์ป่า (Wildlife Friends Foundation Thailandประเทศไทย ภายใต้หัวข้อการตรวจสอบสืบสวนการค้าสัตว์ป่าผิดกฎหมายออนไลน์ ทางมูลนิธิ ฯ มีความยินดีที่จะแบ่งปันเรื่องราวเกี่ยวกับการจับกุมผู้ลักลอบค้าสัตว์ป่าออนไลน์ เช่น แพนด้าแดง เสือไฟ รวมถึงลูกหมีควาย ตามช่องทางการค้าออนไลน์ต่างๆ

ในกรณีนี้ ผู้ค้าได้ทำการเสนอขายลูกหมีควายในกลุ่มผู้ซื้อสัตว์ป่าออนไลน์ในประเทศไทย และถูกติดตามจากทีมงานสืบสวน ของมูลนิธิฯ จึงทราบว่าต้นทางการค้ามาจากประเทศเวียดนาม แต่ความซับซ้อนในกระบวนการทางกฎหมายระหว่างประเทศ ต่อการจับกุมผู้กระทำผิดนั้นเป็นไปได้ยาก ดังนั้นทางมูลนิธิ ฯ จึงติดต่อไปยังองค์กร Education for Nature – Vietnam (ENV) ในประเทศเวียดนาม ซึ่งเป็นองค์กรพันธมิตร เพื่อขอความร่วมมือในการสืบสวนข้อมูลของผู้ค้า ทางองค์กร ENV ได้ประสานงานกับตำรวจเวียดนามและสายลับ เพื่อทำแผนล่อซื้อลูกหมีควาย

สองวันถัดมาทางทีมเวียดนามได้จับกุมผู้ค้าหญิงชาวเวียดนาม และได้ช่วยเหลือลูกหมีควาย 2 ตัวได้สำเร็จ แต่ถึงกระนั้นผู้กระทำผิดจะไม่ถูกตัดสินจำคุก เนื่องจากกฎหมายเวียดนามกำหนดไว้ว่าหากผู้กระทำ ผิดมีบุตรที่มีอายุน้อยกว่า 36 เดือน จะได้รับการละเว้นโทษจำคุก ข้อยกเว้นหรือช่องว่างทางกฎหมายเหล่านี้เป็น ช่องทางของอาชญากรในการกระทำผิดทั้งด้านการค้ามนุษย์ ยาเสพติด รวมไปถึงการค้าสัตว์ป่า

ลูกหมีควาย ขณะนี้ได้ถูกส่งไปยังองค์กรช่วยเหลือสัตว์ป่าในประเทศเวียดนาม ทางมูลนิธิเพื่อนสัตว์ป่า ประเทศไทย ขอขอบคุณองค์กร ENV และ ผู้สนับสนุนหลักในการต่อต้านการค้าสัตว์ป่า(โดยเฉพาะ ในภูมิภาคเอเชียตะวันออกเฉียงใต้) กระทรวงสิ่งแวดล้อม อาหาร และชนบท (Department for Environment, Food and Rural Affairs (Defra) และ สำนักงานสืบสวนสิ่งแวดล้อม(Environmental Investigation Agency) ของประเทศอังกฤษ จากความมือระหว่างประเทศที่เกิดขึ้นครั้งนี้ จะเป็นแรงผลักดันให้เราต่อสู้กับอาชญากรรมการค้าสัตว์ป่าข้ามชาติต่อไป
